A Legal Study on the Environmental Impact Assessment

초록

Environmental Impact Assessment (EIA) is derived from Section 102(2) of the Naitonal Environmental Policy Act (NEPA) of 1969 which marked a turning point in environmental legislation in the Unitede States. NEPA requires that an environmental impact statement or EIS be prepared on every "major federal action" undertaken or permitted. If the agency determines that the project will not have a significant effect on the environment, it may prepare a finding of no significant impact or "FONSI" to that effect. An agency's EIS must consider alternatives and mitigation measures that would lessen the project's impacts. It must be made available in draft form for public comment and the agency must respond to those comments received in the Final EIS. Environmental Impact Assessment of Korea is firstly derived from Section 5 of the Environmental Preservation Act which was passed in 1977. Now EIA of Korea should to all actions likely to have a significant environment effect.
